Suppression hearing delayed for Rivera in murder case

POWESHIEK COUNTY, Iowa (KWWL)–The suppression hearing for man accused of murdering Mollie Tibbetts has been postponed for today.

Cristhian Bahena Rivera was expected to be in court today for the hearing. However, one of the attorneys in the case had a death in the family, which caused the delay.  A new date for the suppression trial has not been set.

Rivera’s suppression trial comes after his attorney said, he wasn’t properly read his Miranda Rights.  State prosecutors agree his initial interview with authorities should not be used as evidence.  Officials say, the officer “inadvertently” failed to inform him anything he said, could be used against him in court.

A judge will decide what evidence will be allowed  at trial.
