Woman charged in fatal crash leaving 8-year-old boy dead

MARSHALLTOWN, Iowa (KWWL) – A Marshalltown woman is facing charges after a fatal crash.

Marshalltown Police said Marilyn Diggins, 71, is charged with Failure to Yield to the Right of Way to a Pedestrian.

On the afternoon of May 15 in Marshalltown, Christian Maxon, 8, was hit and subsequently died. The incident happened at the intersection of 13th and West Main Streets.

Maxon was a student at Franklin Elementary School and was on his way home from school.

Cpt. Christopher Jones said Diggins has been released from custody and will appear in Marshall County Court Friday, May 31 for an initial appearance on the charge.
